February 2, 2010 Monthly Meeting
Town of Upham Monthly Meeting February 2, 2010 Chairman Larry Anderson called the February meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. A full quorum is present. Also present were, James Jansen, Roger Henke, Leah Antoniewicz and Tim Murphy and 22 registered visitors. The Clerk read the minutes of the January meeting. Supervisor Henke made a motion to accept the minutes as read. Supervisor Jansen seconded. Minutes approved. The Treasurer reported the balance as of January 1, 2010 as $752,994.30, total receipts as of January 31, 2010 of $894,548.16 and total disbursements as of January 31, 2010 of $621,727.30. Balance on hand as of January 31, 2010 was $1,025,815.16. Supervisor Jansen made a motion to accept the Treasurer’s report. Chairman Anderson seconded. Motion carried. Chairman Anderson presented the January road improvement report. Chairman Anderson read a letter from John Simonsen of the DNR dated 12/18/2009 requiring the town to reset “‘the new culvert” with the bottom at least 6” below the level of the stream bed so as not to impede the movements of fish and other aquatic organisms.’” The letter asked for written commitment from the town by February 1, 2010 that outlines a plan and schedule to reset the culvert. The DNR is willing to allow two years for the town to budget the necessary funds and to work with local groups that may be willing to help share the cost of the project. Chairman Anderson read a letter from Tim Rusch of Rusch Engineering & Surveying providing explanation of actions and communications between him and the DNR regarding the placement of the current culvert. A brief discussion took place regarding the possibility of the Langlade County Highway Department paying the cost to reset the culvert to comply with the DNR requirement. Tom Schultz, Langlade County Highway Department committee member, said that that town is on the agenda for the February 10, 2010 meeting to request the County Highway Department to pay the cost of resetting the culvert. The meeting begins at 7:30 a.m. Chairman Anderson recommended that the town seek legal counsel. He informed the board that he had contacted the Wisconsin Towns Association to get a referral for an attorney and had been given the name of an attorney from Madison who specializes in waterway cases. Chairman Anderson made a motion to hire legal counsel for a preliminary legal opinion if Langlade County denies the town funds to reset the culvert. Supervisor Jansen seconded. Motion carried. Chairman Anderson read the Elcho Fire & Rescue 2009 report. Chairman Anderson read the proposed Resolution 01-10 in opposition to the DOR County Assessment Proposal. Supervisor Jansen made a motion to adopt Resolution 01-10. Supervisor Henke seconded. Motion carried. The board discussed purchasing a wheel loader. They decided to keep looking. Supervisor Henke made a motion to pay the bills. Supervisor Jansen seconded. Motion carried. Supervisor Jansen made a motion to adjourn the meeting. Chairman Anderson seconded. Meeting adjourned.
